I know it is illegal to sell a shotgun that is out of proof.
However, can one be given or transferred to a new owner? And does it matter if they are told it is out of proof or not?
Yes, I know there are dangers in out of proof guns but want to know the legal position of the person transferring ownership.

Are we talking a Section 58 firearm, or a S1 or 2?
If it's S58 then you can simply "give" it to them, as S58s are off-ticket.

I believe the gun proof act mentions it being an offence to: offer for sale, sell, exchange or export a small arm which is out of proof.
So unless it's an antique, you're legally snookered.
